Offences under the Indian Penal Code 1860 are classified as under:
I) Cognizable and Non-Cognizable
1. Cognizable: These are the offences where a police officer may arrest without warrant.
2. Non-Cognizable: These are the offences where an arrest warrant is required for arresting the accused.
II) Bailable and Non-Bailable
1. Bailable: In bailable offences, the person arrested can be released on suitable bail by the Police or the Court.
2. Non-Bailable: In these cases, the arrested person is not automatically entitled for bail but the court can allow him/her to be released against suitable bail and without or without conditions.
In simple language, arrested person can be released from the Police Station in case of Bailable Offence but only the court has the authority to grant bail in non-bailable offence.
